1. General Terms

Your use of our website and services signifies agreement to these Terms, alongside our Privacy Policy. If you disagree, please discontinue use.

UXwize reserves the right to update these Terms periodically. Any changes will be posted here, and continued use of the website or services indicates acceptance of such updates.

2. Services

2.1 Scope of Services

UXwize provides UX research services, including usability testing, user interviews, user journey mapping, A/B testing, persona development, and other research-related tasks tailored to client requirements.

2.2 Task Limits and Turnaround Time

Clients may request one task at a time. We strive to complete each task within 2-5 business days, though this may vary based on complexity. For extensive tasks, a timeframe estimate will be provided. Tasks and project progress are managed on the Trello platform, where clients can track updates, provide feedback, and view task statuses.

2.3 Service Availability

Our services are subject to availability, and UXwize reserves the right to modify or discontinue any service at its discretion. If no immediate availability exists, clients may choose to join a waiting list, and we will notify them as soon as an opening becomes available.

3. Fees and Payments

3.1 Pricing

All prices are listed in Euros and may be subject to change. Specific monthly fees for each service are charged according to the subscription terms set in Stripe. UXwize reserves the right to adjust fees based on Stripe subscription terms or service modifications, with prior notice to the client.

3.2 Payment Terms

Payment is required in advance. Accepted payment methods include credit card payments via Stripe and bank transfers.

4. Satisfaction Guarantee and Refund Policy

4.1 Full Refund Guarantee

If the client is not satisfied with the quality of the service provided, they may request a full refund. A refund will be issued if:
• UXwize has made a genuine attempt to address the client’s concerns.
• Both parties are unable to agree on reasonable terms for fixing the issues raised.

4.2 Exclusions to Refund Eligibility

Refunds do not apply when dissatisfaction arises from specific research results or insights delivered, nor when internal team performance issues are outside UXwize’s control.

4.3 Process for Refund Requests

Clients must submit dissatisfaction claims in writing, specifying all concerns within 7 days following the task’s placement in the "Completed Tasks" section in Trello. UXwize will review the claim and, where feasible, propose adjustments before any refund is processed.

5. Client Responsibilities

5.1 Accuracy of Information

Clients must provide accurate information. UXwize is not liable for delays or issues due to inaccurate client-provided data.

5.2 Timely Feedback

Clients agree to provide timely feedback for tasks, understanding that delays may affect turnaround time.

5.3 Professional Conduct

UXwize reserves the right to terminate services if client interactions violate these Terms.

6. Intellectual Property

6.1 Deliverables Ownership

Upon full payment, clients receive a non-exclusive license to use the deliverables for their intended purpose. Resale or unauthorized distribution without UXwize’s consent is prohibited.

6.2 Website Content

All content on UXwize’s website, including text, images, and graphics, remains UXwize property and cannot be reproduced without permission. Some images sourced from third parties (e.g., Unsplash) are subject to their respective licensing terms.

6.3 Right to Publicize Work

UXwize may feature completed client projects for marketing purposes unless the client requests privacy or an NDA is signed.

7. Confidentiality and Privacy

7.1 Confidentiality Obligations

All client information is treated as confidential and used solely for service provision. Disclosure occurs only when legally required.

7.2 Privacy and Data Security

UXwize follows robust data security protocols and clients have the right to request access, deletion, or correction of their data in accordance with GDPR compliance, as outlined in our Privacy Policy.

7.3 Non-Disclosure Agreement (NDA)

Upon request, UXwize can enter into an NDA to formalize confidentiality for sensitive projects.

7.4 Third-Party Data Handling

Certain data may be shared with third-party service providers solely for operational needs, in compliance with GDPR and our Privacy Policy.

8. Limitation of Liability

8.1 No Warranty

All services are provided “as is,” without any express or implied warranties. UXwize does not guarantee specific outcomes from its services.

8.2 Liability Limitation

UXwize is not liable for indirect, incidental, or consequential damages related to website or service use. Liability is limited to the amount paid by the client for services.

9. Termination

9.1 Termination by UXwize

UXwize reserves the right to terminate services or limit access if these Terms are breached.

9.2 Termination by Client

Clients may manage or terminate their subscription at any time directly through Stripe. Refunds and cancellation policies, including any prorated charges, will be applied per the terms set within the Stripe subscription settings.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Estonia. Disputes are subject to the exclusive jurisdiction of the courts in Estonia.
